内容简介 Abstract

在国际舞台上，个别国家和区域组织以各种形式积极使用单边制裁。近年来，不仅初级单边制裁的实施力度不断增强，还衍生出次级制裁以及对规避制裁的民事、刑事与行政处罚，导致企业倾向过度遵从。

Unilateral sanctions are actively used at the international arena by individual states and regional organizations in various forms. Recent years are also characterized by the expanding enforcement of primary unilateral sanctions via different means: secondary sanctions, civil, criminal, administrative penalties for circumvention of sanctions regimes, as well as consequent over-compliance.

此次讲座将对不同类型的单边制裁进行概述，明确将其定性为单边强制措施的标准；确定初级单边制裁的地位和执行手段；分析单边制裁在国际法不同领域的评估和适用问题，如条约法、国家责任法、国际法原则、司法和职能豁免、国际贸易法和人权法。

The lecture will present an overview of different types of unilateral sanctions;  identify the criteria of their qualifications as unilateral coercive measures; qualify the status and the means of enforcement of primary unilateral sanctions; and demonstrate challenges of assessment and application of unilateral sanctions in different areas of international law: law of treaties, law of international responsibility, principles of international law, judicial and functional immunities, international trade law and law of human rights.

讲座还将说明单边制裁的适用与执行，以及过度遵从在不同国家可能造成的人道主义影响。

It will also demonstrate possible humanitarian impact of the use of unilateral sanctions, means of their enforcement and over-compliance in different countries.

演讲人简介 Speaker's Short Bio

阿莱娜·杜晗教授，博士、特许任教资格博士，现任联合国人权理事会单边强制措施对享受人权的不良影响问题特别报告员，白俄罗斯国立大学国际法教授、国立大学和平研究中心主任，波鸿鲁尔大学和平与武装冲突国际法研究所联席成员。

Professor Alena Douhan, Dr. Dr. hab.，The Special Rapporteur on the negative impact of the unilateral coercive measures on the enjoyment of human rights. Alena Douhan is a professor of International Law, the Director of the Peace Research Center at the Belarusian State University (Belarus) and Associated member of the Institute for International Law of Peace and Armed Conflict at Ruhr University Bochum.
