Businesses are requested to monitor the upstream and downstream of their supply chains due to unilateral sanctions. They might be confronted with severe penalties if sanctioning states believe that they violate or circumvent or assist in any way in circumvention of sanctions regimes. However, when any negative humanitarian consequences take place, states, international organizations and businesses tend to shift blaming responsibility onto each other. 本讲座将从国际法和人权法的角度,探讨企业人权义务的本质;阐述企业注册国、第三国与企业之间面对制裁的责任分配,尤其是人权尽责的边界。除此之外,讲座还将介绍目前制定《制裁、商业和人权指导原则》的进展。 The lecture addresses the very nature of obligations of businesses from the perspectives of international law and law of human rights. It demonstrates the scope of mutual human rights obligations of states of registration, third states and businesses particularly regarding the due diligence requirement in the context of sanctions. It also outlines the work done to prepare the Guiding Principles on Sanctions, Business and Human Rights. 演讲人简介 Speaker's Short Bio 阿莱娜·杜晗教授,博士、特许任教资格博士,现任联合国人权理事会单边强制措施对享受人权的不良影响问题特别报告员,白俄罗斯国立大学国际法教授、国立大学和平研究中心主任,波鸿鲁尔大学和平与武装冲突国际法研究所联席成员。 Professor Alena Douhan, Dr. Dr. hab.,The Special Rapporteur on the negative impact of the unilateral coercive measures on the enjoyment of human rights. Alena Douhan is a professor of International Law, the Director of the Peace Research Center at the Belarusian State University (Belarus) and Associated member of the Institute for International Law of Peace and Armed Conflict at Ruhr University Bochum.
